1. About these Terms
These Terms of Service ("Terms") govern your access to and use of the Voicgen website, platform, APIs, generated outputs, and related services (together, the "Services").
By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of a company or organisation, you confirm that you have authority to bind that entity.
If you do not agree to these Terms, you must not use the Services.
2. Who we are
Voicgen is operated by Codemynt Ltd ("Voicgen", "we", "us", "our").
Support: [email protected]
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to use the Services.
4. Your account
You may need to create an account to use some or all of the Services.
You are responsible for:
- providing accurate account information;
- keeping your login credentials secure;
- all activity that occurs under your account; and
- notifying us promptly of any unauthorised access or security incident.
We may suspend or restrict access if we reasonably believe your account has been compromised or used in breach of these Terms.
5. The Services
Voicgen provides tools to transform written content into audio and related outputs, including features such as audio generation, playback tools, summaries, transcripts, multilingual workflows, analytics, integrations, and other functionality that may change over time.
We may add, remove, improve, or modify features from time to time.
6. Plans, subscriptions, and usage limits
Some features of the Services are available only on paid plans.
Your subscription may include limits such as:
- number of articles;
- number of audio minutes;
- access to certain features; and
- API or integration access.
If your plan includes multiple usage limits, the applicable limit may be whichever is reached first.
We may monitor usage to enforce plan limits, prevent abuse, and protect service performance.
7. Fees and payment
You agree to pay all applicable fees for your chosen plan.
Unless otherwise stated:
- subscriptions are billed in advance on a recurring basis;
- fees are non-refundable except where required by law;
- taxes may be added where applicable; and
- failure to pay may result in suspension or termination of access.
Payments are processed by third-party payment providers. We are not responsible for errors caused by those providers, except as required by law.
8. Renewals and cancellation
Paid subscriptions renew automatically unless cancelled before the next billing date.
You can cancel your subscription through your account settings or by contacting us. Cancellation will usually take effect at the end of the current billing period unless we state otherwise.
If mandatory law gives you cancellation, cooling-off, renewal reminder, or refund rights, those rights are not affected by these Terms. The UK government has recently announced and consulted on stronger subscription protections, so your live checkout and renewal process should also be reviewed for compliance when you implement billing UX.
9. Enterprise services
Enterprise plans may be subject to separate order forms, statements of work, service level commitments, or negotiated terms.
Where agreed in writing, Enterprise customers may receive service levels, support response targets, onboarding, or other SLA commitments. If there is any conflict between these Terms and a signed enterprise agreement, the enterprise agreement will control to the extent of that conflict.
10. Your content
You retain ownership of the text, materials, data, and other content you submit to the Services ("Input"), subject to any rights you grant us under these Terms.
You grant us a non-exclusive, worldwide, limited licence to host, store, process, reproduce, and use your Input as needed to:
- provide the Services;
- generate outputs;
- maintain service performance and reliability;
- ensure security, compliance, and abuse prevention; and
- comply with legal obligations.
You are responsible for your Input and for ensuring you have all necessary rights, permissions, and lawful bases to use it with the Services.
11. Generated outputs
Subject to your compliance with these Terms and any third-party restrictions, you may use the audio files, summaries, transcripts, and other outputs generated through the Services for personal, internal business, and public publishing purposes.
You acknowledge that:
- generated outputs may contain errors or inaccuracies;
- automated summaries, transcripts, and translations should be reviewed before use; and
- output quality may vary depending on source content, language, voices, integrations, and technical factors.
12. No training on customer content by Voicgen
Voicgen does not use your submitted content or generated outputs to train or improve Voicgen models.
However, third-party providers that help us deliver the Services may process data under their own terms and policies. ElevenLabs' published materials, for example, describe service delivery, compliance, safety review, and deidentified or aggregate processing in certain circumstances.
13. Acceptable use
You must not use the Services to:
- break any law or regulation;
- infringe intellectual property, privacy, or other rights;
- upload or process content you do not have the right to use;
- generate deceptive, fraudulent, abusive, defamatory, or unlawful material;
- interfere with or disrupt the Services;
- reverse engineer, scrape, probe, or exploit the Services except as allowed by law;
- circumvent plan limits, billing rules, or access controls; or
- use the Services in a way that could damage our systems, reputation, or users.
We may investigate suspected misuse and may suspend or terminate access where we reasonably believe these Terms have been breached.
14. Third-party services and integrations
The Services may interoperate with third-party products, platforms, and providers.
Your use of third-party services is subject to the terms and policies of those third parties. We are not responsible for third-party services, including their availability, security, performance, or data handling practices.
15. Intellectual property
We own or license all rights in the Services, including our software, branding, design, site content, and underlying technology, except for your Input and any rights you may have in outputs.
These Terms do not transfer ownership of our intellectual property to you. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Services in accordance with your subscription and these Terms.
16. Beta features
We may offer beta, preview, or experimental features. Those features may be incomplete, changed, or withdrawn at any time, and may be provided without any warranty or service commitment.
17. Service availability
We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free availability.
We may suspend access temporarily for maintenance, upgrades, security reasons, legal reasons, or technical issues.
18. Disclaimers
The Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law.
We do not guarantee that:
- the Services will always be uninterrupted, secure, or error-free;
- generated outputs will be accurate, complete, or fit for a particular purpose; or
- the Services will meet every requirement or workflow you may have.
19. Limitation of liability
Nothing in these Terms limits or excludes liability where it cannot legally be limited or excluded.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive losses, or for loss of profits, revenue, business, goodwill, data, or opportunity.
Our total aggregate liability arising out of or relating to the Services will not exceed the total fees paid by you to us for the Services during the 12 months before the event giving rise to the claim, or £100 if you have not paid us any fees.
20. Indemnity
You agree to indemnify and hold harmless Voicgen, Codemynt Ltd, and their officers, employees, and affiliates from claims, losses, and expenses arising from:
- your Input;
- your use of the Services in breach of these Terms; or
- your violation of any law or third-party rights.
21. Suspension and termination
We may suspend or terminate your access immediately if:
- you materially breach these Terms;
- you fail to pay fees when due;
- we reasonably suspect fraud, abuse, or unlawful activity; or
- we are required to do so for legal or security reasons.
You may stop using the Services at any time and may cancel your subscription in accordance with these Terms.
Sections that by their nature should survive termination will continue to apply, including sections on payment, intellectual property, disclaimers, liability, indemnity, and governing law.
22. Changes to the Services or Terms
We may update the Services and these Terms from time to time. If we make material changes to these Terms, we will post the updated version and may notify you by email or through the Services.
Your continued use of the Services after the updated Terms take effect means you accept the revised Terms.
23. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales, unless mandatory local law requires otherwise.
The courts of England and Wales will have exclusive jurisdiction over disputes arising from or related to these Terms, except where applicable consumer law provides otherwise.
